• New stimulus Plan Tax Incentives For Buyers Of Electric Scooters

Energy conscious consumers considering purchase of electric vehicles and electric scooters have an increased incentive to purchase these vehicles due to a tax credit buried in the recent Economic and Reinvestment Act of 2009.

Incentives for plug- in hybrid vehicles take effect in 2010 but incentives for smaller electric vehicles take effect with the passage of the bill. The $787 Billion bill passed by the Congress, and signed by the President gives a tax credit incentive to purchasers of electric vehicles of different types.

All electric powered vehicles benefit from the new tax credit. Immediately benefiting are buyers purchasing a category of vehicles known as light electric vehicles or LEV’s. The LEV category includes four wheeled Neighborhood Electric Vehicles or NEV, and two and three wheel electric powered scooters.

The criteria for qualifying are based on the electric energy storage capacity of the battery. For two and three wheel vehicles the minimum size battery storage that qualifies must be rated at a minimum of 2.5kwh of stored energy capacity. For a NEV type vehicle the minimum battery storage capacity that qualifies is 4 kWh. To determine if the vehicle you are considering qualifies take the amp hour capacity rating of the battery times the battery voltage and divide by 1000. If the result is 2.5 or greater, the scooter, or three wheel vehicle, will qualify for the credit. For example if the specifications on the scooter you are considering has a battery rated: 5X12V/50 Ah the calculation is as follows: (5X12v) 60 X 50 Ah = 3000 Divided by 1000 = 3 KWh, which exceeds the 2.5 kWh minimum criteria.

For vehicles that qualify there is a 10% tax credit on electric vehicles up to a maximum purchase price of $25,000 which would result in a maximum credit of $2,500 on a vehicle costing $25,000. This tax credit may be in addition to local tax or purchase incentives that may be in place in some local municipalities, and is effective for purchases made after the date the bill was signed

The tax credit incentive will be welcome news to anyone considering purchase of an electric scooter.

  • Life Insurance In India – Who Needs It

Comments Off on Life Insurance In India – Who Needs It

Why Do You need Life Insurance Policy ?
    When needs it?
Life Insurance policy provides either a lump sum or an income on the untimely death of an individual. Therefore, anyone who’s death would make a financial loss to another has a need for life insurance policy. This should contain the followings: –
    1.Mortgage Life Insurance Cover
    2.Anyone with dependents
    3.Key Individuals.
In essence any situation where monetary loss would be incurred could possibly have a need for life insurance policy.
60,000 people in the India have died in 2008* *source: Terrorist Attack

    Types of Cover:

    Term Life Insurance
Term life insurance as the name suggests pays a death benefit only during a specified term of coverage which usually ranges between 10 and 30 years. Term life is the cheapest and most financially efficient form of life insurance for most young and middle-aged people the premiums on term policies are relevantly low since the likelihood that they will die during the term of the policy is small.
Furthermore term insurance is appropriate for most people because they can select a term that will cover them during their time of the greatest financial need.

    Whole Life Insurance
Contrasting term insurance, a whole of life policy pays a death benefit no matter when you die. Of course, you usually have to pay premiums for a lifetime as well. For most people, whole life insurance provides coverage that’s actually unnecessary. If you die at age 85, will your widowed spouse or children really need an extra 200,000 to keep going? Insurance salespeople often try to convince customers to buy whole life insurance because of its investment component. A portion of your premiums go into an investment fund which grows at a varying rate, depending on the performance of the stock market. This produces a couple of supposed benefits. One thing, the premiums you pay may be reduced in the future if the investment fund performs well.

    Which one?
There are good arguments for both type of policy. We would suggest that the following could make up the main considerations: –
Cost – Whole Life insurance ,is more expensive type of product.
Period that cover is required – If cover is required for a specific period i.e. a Mortgage then Term life insurance policy could be more appropriate
Future Plans – If, for instance a family is planned, then whole of life can offer the flexibility to increase cover for this or other like events.

    Conclusion:
Life insurance is needs everyone. At Policy Bazaar you can compare and buy life insurance policy according to your requirement. If any help require regarding to insurance you can call to call center to available such special offers at 0124 457 67 77 and also see website:

  • Travel Insurance Fraud The Consequences

Rebecca and Shanti were both honest law-abiding citizens with law degrees from Sussex University, so it came as something of a surprise when they were recently arrested in Brazil for committing holiday insurance fraud. The two girls allegedly told the police that thieves had stolen around 1,000 of their possessions, including a camera and laptop computer. However, officers became suspicious of their calm demeanour and the fact that it had taken the girls days to report the alleged offence.

The police subsequently demanded to see the girls lodgings, where they claim to have uncovered all the possessions which the girls claimed had been stolen en-route to Brazils Iguassu Falls. Rebecca and Shanti could face up to five years imprisonment if they are found guilty of committing holiday insurance fraud in Brazil, and this sentence is actually quite lenient when you consider some of the punishments that they could face if they had committed the crime in a different country.

In England, tourists face up to 10 years imprisonment as a result of making fraudulent holiday insurance claims. This sentence could even be on top off additional penalties, such as repayment of the amount you claimed and compensation to your travel insurance company. You would have thought that the prospect of a ten year prison sentence would put most people of committing travel insurance fraud, but last year 4,300 dishonest claims worth 5million were made through holiday insurance companies in the UK alone.

Overseas police forces and travel insurance companies, have now started to get increasingly more vigilant about holiday insurance cheats, a policy which no doubt led to the arrest of Rebecca and Shanti. Details of fraudulent travel insurance claims have now been kept on an industry-wide database, which will be accessed by the Financial Services Authority and insurance companies. This means that anyone caught trying to commit holiday insurance fraud will now automatically face higher insurance costs and have difficulty obtaining other insurance cover, such as home insurance. On top of this, attempting to commit travel insurance fraud may also impact on your credit rating, which would make it more difficult to obtain goods or borrow money in the future.

It is reported that 75,000 Britons have at some point in their lives committed holiday insurance fraud, either by making a false claim or by exaggerating an existing one. Records from travel insurance companies show that Britons lose more Louis Vuitton luggage abroad than is actually ever sold in the UK.

So many fraudulent claims, however, could see the end of cheap travel insurance, as holiday insurance companies may need to put up their prices in order to make up for the losses that they may incur.

Rebecca and Shantis Brazilian sentence may have seemed tough, but if the girls had attempted to commit holiday insurance fraud within the UK then they would have risked a much stricter sentence.

  • Refund of Service Tax Issues & Challenges

    January 9, 2020 /  Tax and Insurance

Service Tax, as the name suggests is a tax leviable on all duties. It is a tax levied on the transactions of the facility specified by the Central Government under the finance Act, 1994. It is an indirect tax (akin to Excise duty or Sales tax), which means the service provider pays the tax and recovers the amount from the recipient of the taxable work.

Service Tax is generally recovered by Assessee in two ways:

By utilizing the same as in the form of Cenvat Credit, or

    By Claiming the Refund.

Any Assessee can utilize the amount of duty paid by him in excess by adjusting the same with the duty amount paid in subsequent period. Refund of tax can be claimed by Assessee where self- adjustment of Service Tax is not feasible.

Refund of Service Tax generally happens in case of export oriented companies (STPI, SEZ, EOU units) which export their final product/duty, as no tax is levied by Government to promote the export. Such companies disburse excise on the input/output assistance procured by them but are not able to utilize the Cenvat Credit because no due is received by them on export of their services. As a result, such companies have to opt the procedure of claiming refund for unutilized cenvat (tax) credit.

The Export Oriented Units, especially the STPI units have been facing many hurdles and difficulties while claiming the service tax refunds. There had been inordinate delays towards the scrutiny of refund applications coupled with rejections of the claimed amounts due to various reasons by the designated authorities, primary reasons being:

Time Limitation for the refund claim of duties.
Relevant date for the calculation of limitation period in respect of filing the refund claim.
Implication of the Principle of Doctrine of Unjust Enrichment.
Submission of separate Foreign Exchange Remittance Certificate (FIRC) in case of segregated export of goods & utilities.
Submission of Original documents such as Invoice, BL, SB, BRC etc.

The Central Board of Excise & Customs is seized of this matter and has been regularly clarifying on this issue through various clarifications/Notifications covering many procedural issues with respect to refund of service tax paid. It has settled many issues like the time within which the refund claim shall be filed, acceptance of certified photocopies as a valid document, submission of self-certified statement along with FIRCs etc.

Despite various initiatives taken by the department, there has been a huge pendency of tax refunds primarily because of the incomplete documentation by the claimants, tedious process of physical verification of documents submitted to the department and the difference of perception between the claimant and the department regarding the admissibility of input services eligible for refund.

There are many specialized Service Tax Consultant in Delhi, NCR that helps companies in sorting out the problems they face related to tax. But it is always advisable to do some serious research before contacting a STPI Consultant in Delhi.

  • Fundamental Principles Of Insurance

Comments Off on Fundamental Principles Of Insurance
    January 7, 2020 /  Tax and Insurance

Insurance is a contract, a risk transfer mechanism whereby a company (Underwriter) promised to compensate or indemnify another party (Policyholder) upon the payment of reasonable premium to the insurance company to cover the subject-matter of insurance. If you are well conversant with these principles, you will be in a better position in negotiating you insurance needs.

    1. Insurable interest. This is the financial or monetary interest that the owner or possessor of property has in the subject-matter of insurance. The mere fact that it might be detrimental to him should a loss occurred because of his financial stake in that assets gives him the ability to insure the property. Castellin Vs Preston 1886.

    2. Umberima fadei. It means utmost good faith, this principle stated that the parties to insurance contract must disclose accurately and fully all the facts material to the risk being proposed. That is to say that the insured must make known to the insurer all facts regarding the risk to be insured (Looker Vs Law Union and Rock 1928). Likewise, the underwriter must highlight and explain the terms, conditions and exceptions of the insurance policy. And the policy must be void of small prints.

    3. Indemnity. It stated that following a loss, the insurer should ensure that they placed the insured in the exact financial position he enjoyed prior to the loss (Leppard Vs Excess).

    4. Contribution. In a situation where two or more insurers is covering a particular risk, if a loss occurred, the insurers must contribute towards the settlement of the claim in accordance with their rateable proportion.

    5. Subrogation. It has often been said that contribution and subrogation are corollary of indemnity, which means the afore-mentioned two principles operates so that indemnity does not fail.

Subrogation operates mainly on motor insurance. When an accident occurred involving two or more vehicles, there must be tortfeasor(s) who is responsible for accident. On this basis, the insurer covering the policyholder who was not at fault can recover their outlay from the underwriter of the policyholder who is responsible for the incidence.

  • Claims Payment Record Of The Private Insurance Companies

Comments Off on Claims Payment Record Of The Private Insurance Companies
    January 6, 2020 /  Tax and Insurance

As we know, there are 20 odd private life insurance companies in India, and there is LIC which is a public sector company. LIC is the 800 pound gorilla, managing to hold on to about 75% market share even 10 years after private companies have been allowed into the life insurance space. The private life insurance companies position themselves on being more customer friendly, wider array of products etc while LIC holds on to its positioning of trust, experience and government backing. One of the key parameters on which to judge a life insurance company is their claims payment record. At the same time, we must note that given that life insurance has become more of a savings and investment product, the returns that they provide are perhaps more important than claims payout ratios. Nevertheless, claims record is definitely not a variable to be ignored.

A table illustrating the claims rejection percentages of the top life insurance companies in 2009-10 is presented below:

    Life Insurance Company
    Claims rejection ratio (%)

    LIC 1.21%
    Aviva 9.75%
    Bajaj Allianz 5.2%
    Birla SunLife 10.62%
    HDFC Life 4.67%
    ICICI Prudential 3.27%
    ING Vysya 4.26%
    Kotak Mahindra 4.29%
    Max New York Life 12.31%
    MetLife 5.94%
    Reliance Life 7.05%
    SBI Life 14.75%
    Tata AIG 12.3%

An important observation from the above table is that the claims rejection ratio of LIC is the lowest, thus implying that their record is the best as far as claims payment is concerned. At the same time, the very high percentage of claims rejection of SBI Life and Max New York Life surely comes in as a surprise.

It must however be noted once again that in Unit Linked products that life insurance companies promote aggressively (or at least was promoting till Sep 2010) , the returns earned on the fund is perhaps a more important variable than the claims payment (or rejection) ratio. However, for non life insurance companies, which offer pure protection/insurance products with no savings or investment component, claims payment is the crucial variable along with the speed of processing of claims.

Let us now look at the incurred claims ratios of the non life insurance companies:

    Non Life Insurance Company
    Incurred claims ratio

    New India Assurance 89%
    Oriental Insurance 99.69%
    United India Insurance 78.62%
    National Insurance 99.16%
    Royal Sundaram 68.95%
    Reliance General Insurance 77.3%
    Iffco Tokio Insurance 83.44%
    Tata AIG 60.54%
    ICICI Lombard 85.35%
    Bajaj Allianz 71.9%
    HDFC Ergo 80.73%
    Bharti Axa 104%%

One data point that stands out from above is that Tata AIG General Insurance seems to be sourcing the best quality business from the underwriting point of view, whereas the claims payment ratio of Bharti Axa seems to be quite high. Alo,the claims payment ratio of the public insurers, at an overall level, is higher than that of the private non life insurers.

  • Classifications Of Insurance

Comments Off on Classifications Of Insurance
    December 31, 2019 /  Tax and Insurance

Insurances are classified in a number of ways. The policy term and coverage differentiates one from the other. Risks, perils, losses, and property, are the different coverages. A detailed analysis and a deeper understanding of the characteristics should be made for a certain insurance policy to be classified.

Most of the time private and social assurance are distinguished from one another. Social insurance is offered by public agencies and it is mandatory. While there are a lot of coverages that are offered by the government that are considered compulsory. But the are also those that are voluntarily bought. Also, private insurance companies offer compulsory insurance. It doesn’t matter who the provider of the insurance is as the distinction between compulsory and voluntary insurance doesn’t depend on them. A compulsory insurance, who ever provides it, is considered as a social insurance.

Personal, property, and liability risks are the coverages included in a private voluntary insurance. Disability and medical care coverages are under personal insurance. The coverage for the cost of loss of a certain property, whether it be repair or replacement, or any loss due to the use of that certain property, is under property insurance. Fire, windstorm, riot, civil commotion, and crime, are the most common perils. Personal injury, bodily injury, and property damage caused by persons in their personal, professional, and business activities, are all included in a liability coverage. Further categories include surety bonding and credit insurance.

Governmental voluntary assurance focuses primarily on personal and property risks. In Wisconsin, voluntary insurances are provided for their residents. In another state, crop hail insurance under property coverage is also offered. The US government through the Veterans Administration, provides life insurance to veterans. People who have already retired are also given supplemental medical care insurance on a voluntary basis under the Medicare program through the Social Security Administration. In the case of home loans, the federal housing administration provides loans to its lenders. The US government also joined the marine insurance field during the time of world wars.

Compulsory insurance is further sub-classed into two kinds, either state or federal. Some of these programs are supported by insurers while others are financed by government agencies. Coverage is provided for personal, property, and liability risks.

  • Tax Credits For Truck Drivers

Comments Off on Tax Credits For Truck Drivers
    December 29, 2019 /  Tax and Insurance

Truck drivers, whether they are owner-operators or drive professionally for an organization, can deduct a number of on-the-road expenses on their federal income taxes. Special rules apply to truck drivers; The IRS recognizes the importance of trucking in the national economy and acknowledges there are many expenses incurred in the profession. Owner-operators are afforded a few more deductions to subsidize the expense of owning and operating their semitrucks.

    Equipment and Related Expenses
Owner-operators garner the largest deductions in the equipment and equipment-related expenses category. According to the federal tax code’s Section 179 Deductions for Tangible Property, a truck owner does not have to depreciate his truck over the long term, but may instead be able to make a large one-time deduction. The maximum Section 179 expense deduction for qualified real property is $250,000. Repairs and maintenance to the truck may also be deducted. Truckers are allowed a deduction for gas expenses and the purchase of products related to the operation of the truck as well.

    Communication Expenses
Because truckers are on the road for the majority of their work time, they often spend a great deal on communication expenses. Expenses such as cellphones, cellphone service, CB radios, satellite networks for computers, computer software and laptops may all be included as business-related expenses and are deductible at a percentage of their original cost. If you use your cellphone for personal use as well, you may only deduct business-related usage.

    Personal Expenses
Personal expenses for truck drivers differ from those for businesspeople who are traveling. Truckers often sleep in their trucks instead of paying for a hotel. If you purchase a sleeping bag, bunk, blankets, hot pot or truck stop showers, you can deduct all of these as business- related expenses. Trucking companies will sometimes pay drivers a per diem for food. In these circumstances, the driver cannot deduct the amount of the per diem, but may be able to deduct meals that exceed the per diem up to the IRS limit. Owner-operators who do not receive a company per diem to cover food may use the special deduction for employees involved in transportation. As a truck driver as of 2010, you can claim a standard meal allowance of $59 a day ($65 for travel outside the continental United States). Truckers should verify these deductions annually as they are often modified by the IRS.

    Considerations
Throughout the year, as you conduct your duties as a company truck driver or an owner-operator, you will encounter expenses. To get the most out of your tax deductions, you need to keep and organize all receipts that are business related. Purchasing an expandable file folder and files is an easy way to organize your receipts. Label files according to the nature of the receipts; truck repairs and maintenance, food, lodging, communication and perhaps miscellaneous. If you don’t have an official receipt, include a handwritten receipt with the amount of purchase, date and what it was for.
